Jackson Hewitt Tax’n & Relax’n Sweepstakes Official Rules

Sweepstakes Time Period: The Jackson Hewitt Tax’n & Relax’n Sweepstakes (the “Sweepstakes”) shall begin 12:00:01 AM Eastern Time (“ET”) on Thursday, August 15, 2024, and end 11:59:59 PM ET on Sunday, August 31, 2024 (such period, the “Sweepstakes Period”).

Sponsor: The Sweepstakes is sponsored by Jackson Hewitt Inc., 10 Exchange Place, 27^th Floor, Jersey City, NJ 07302 (the “Sponsor”).

Eligibility: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding Puerto Rico, other US territories and possessions, and where prohibited by law), who are 18 years of age or older at the time of entry. Employees, officers, directors, agents, representatives and their immediate families (spouse, parents, children, siblings, and each of their spouses regardless where they live) or members of the same household of Sponsor, Unique Travel Corp., its affiliates, and parents as well as Sandals Resorts and/or Sandals Resorts related entities, and anyone connected with the operation of the Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to participate or be awarded a prize.  Void outside of the 50 United States and the District of Columbia, and where prohibited, taxed or restricted by law.  You are not authorized to participate in the Sweepstakes if you are not located within the 50 United States or the District of Columbia. 

How to Enter: 
Entrants must (i) follow @jacksonhewitttaxservice on Instagram, (ii) like a Tax’n & Relax’n Jackson Hewitt Sweepstakes post, and (iii) tag a friend and comment on the post with what you’d like to do in Jamaica if you won the Tax’n and Relax’n Sweepstakes, along with the hashtag #JHSweeps.  An eligible person who fully and successfully completes the entry process described here shall be considered an “Entrant” and receive one (1) entry into the Sweepstakes for the Sweepstakes Period.

Instagram may be downloaded for free from the Apple and Google play app stores and the use of the Instagram app and all information provided in connection with the downloading and use of Instagram will be subject to the Instagram privacy policy and terms of use.  Please read these policies carefully before downloading and using this app for entry.

Any attempted entries made in non-compliance with these Official Rules will be disqualified. By participating in the Sweepstakes, each Entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects.

Limit: Maximum One (1) entry per person, per day (maximum 17 entries).

Winner Selection: One (1) potential winner will be selected in a random drawing to be conducted on Tuesday, September 3, 2024, from among all eligible Entries entered during the Sweepstakes Entry Period.  The random winner drawing will be conducted by the Sweepstakes Sponsor, whose decisions, are final and binding in all respects. 

Winner Notification: The potential winner will be notified by direct message via Instagram and may be required to sign and return, where legal, a Declaration of Eligibility and Publicity Release (“Declaration”) and any other required documentation within five (5) calendar days of prize notification.  

If the initial winner does not respond within three (3) days, or if a potential winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and an alternate winner may be selected in a separate random drawing. Upon prize forfeiture, no compensation will be given. 

Prize/Prize Approximate Retail Value ("ARV")/Odds:

Grand Prize: One (1) Grand Prize is intended to be awarded. The winner will receive $2,000 (Two Thousand Dollars) (“Cash”) and a four-day/three-night all-inclusive Caribbean vacation for two (2) adults in a deluxe/luxury category room to any one of the seven (7) Sandals Resorts (winner’s choice) located in Jamaica (“Sandals Prize”). The Cash and the Sandals Prize collectively, “Grand Prize” are subject to the terms and conditions herein and the additional terms and conditions for the Sandals Prize in Schedule A below.

The Cash will be issued in the form of one (1) check and the Sandals Prize in the form of a prize certificate (“Sandals Prize Certificate”) outlining the terms and conditions of the prize and redemption procedures. Approximate Retail Value (“ARV”) of the Grand Prize:  $4,970.00. 

NO TRANSPORTATION WILL BE PROVIDED BY THE SPONSOR NOR THE SANDALS PRIZE PROVIDER.  WINNER IS REPONSIBLE FOR ALL TRANSPORTATION TO AND FROM THE SANDALS PRIZE.

Winner may select from one of the following Sandals Resort locations (the “Sandals Prize”):

• Sandals Montego Bay - Montego Bay, Jamaica
• Sandals Royal Caribbean - Montego Bay, Jamaica
• Sandals Negril - Negril, Jamaica
• Sandals Ochi - Ocho Rios, Jamaica
• Sandals Royal Plantation - Ocho Rios, Jamaica
• Sandals Dunn’s River - Ocho Rios, Jamaica
• Sandals South Coast - Westmoreland, Jamaica

No portion of the Grand Prize is transferable. The Grand Prize will be awarded if properly claimed according to these Official Rules and will be sent within approximately 45 days after the winner is verified. The Sandals Prize is subject the Terms and Conditions in Schedule A, below.  The winner acknowledges and agrees that the Sweepstakes Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the listed prize or regarding the use, value or enjoyment of the Grand Prize, and the winner is personally responsible for any and all federal, state and/or local taxes, levies and/or other governmental charges, as the case may be, in connection with the receipt of the Grand Prize or any portion thereof. The odds of winning will depend on the number of eligible Entries made during the Entry Period.

General Terms and Conditions: No Entrant or winner shall have the right to contest any decision by the Sponsor or/or Sponsor Administrator concerning any aspect of the Sweepstakes or the interpretation of these Official Rules or the determination as to the qualification of Entries/Entrants. Proof of entry is not proof of entry receipt. Neither Sponsor nor the Sponsor Administrator shall have any responsibility or liability for any person’s ability or inability to access the Jackson Hewitt website, Instagram, and Facebook apps. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other cause beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes or if, in the Sponsor’s sole determination, it believes the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned or fairly. In such case, Sponsor may select the winner from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor.  Sponsor reserves the right to disqualify any Entry/Entrant from the Sweepstakes if, in Sponsor’s sole judgment, an Entrant has not complied with these Official Rules, or any Entrant it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes. Without limitation of the foregoing, an Entrant will be disqualified, at the sole discretion of Sponsor, if Entrant attempts (i) to enter the Sweepstakes through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Sweepstakes or circumvent these Official Rules. Only the prize listed and the value listed above shall be awarded. By entering this Sweepstakes, Entrants explicitly agree to release and hold harmless the Sweepstakes Entities, Walmart Inc., their respective affiliates, parent companies, subsidiaries, successors and assigns and their respective advertising, design, and production agencies and print production agencies and all their respective shareholders, directors, officers and employees (collectively, “Released Entities”), one and all, from all liability (including attorney's fees and costs) for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, this Sweepstakes, or possession, acceptance and/or use or misuse of any prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy. The right to receive a prize is non-assignable and non-transferable and no prize substitution or exchange will be allowed except by the Sponsor who reserves the right to substitute a prize (or portion of prize) of equal or greater value in case of unavailability of the prize or an event beyond Sponsor’s control. It is the Entrant’s responsibility to ensure that their entry and contact information is current and accurate so that they may be contacted by Sponsor or the Sponsor Administrator if selected for a prize.

Additional Terms and Conditions: The Sweepstakes is void where prohibited. All federal, state, and local laws and regulations apply. If any provision of these Official Rules is deemed to violate any federal, state, or local law, regulation or ordinance, that provision shall be amended to conform to such law and all other provisions shall thereafter remain in full force and effect. If Sponsor is required by applicable federal, state, or local law, regulation or ordinance, or by action of an administrative agency to cease offering the Sweepstakes in any jurisdiction, Sponsor reserves the right to (i) terminate the Sweepstakes in such jurisdiction in its entirety, and/or (ii) cancel and remove from participation in the Sweepstakes any Entrant residing in such jurisdiction, without penalty and without obligation to any affected Entrant.

Publicity Release: Acceptance of a prize constitutes permission for Sponsor to use the winner's name, voice, photo, image, likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or videos by the Sponsor's photographer/videographer for publicity purposes, without further consent or compensation, unless prohibited by law.  Winners hereby agree to execute any and all documents requested by the Sponsor to convey such rights to own all the results thereof. Notwithstanding such right, nothing contained herein shall be deemed to obligate the Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.

Consumer Disclosure/Award Rules: All Entries are subject to verification and are void if (a) not submitted in accordance with these Official Rules and through legitimate channels, (b) any part of the Entry is counterfeit, altered, defective, illegible, reproduced, tampered with, mutilated or irregular in any way, or (c) the Entry contains printing, typographical, mechanical, or other errors.   

LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES.  IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND PARTICIPATION IN THE SWEEPSTAKES OR WINNER’S USE OR INABILITY TO USE THE PRIZE. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED "AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Dispute Resolution - Arbitration/Class-Action Waiver. By participating in this Sweepstakes, you understand and agree that any dispute, cause of action or claim (“Claim”) arising out of, related to, or in connection with this Sweepstakes between you and any of the Released Parties shall be brought and resolved exclusively by individual binding arbitration in accordance with the rules and procedures of the American Arbitration Association (“AAA”) in effect at the time the Claim is filed. A copy of the AAA rules, forms and instructions for initiating an arbitration are available at www.adr.org or by calling (800) 778-7879.  In an arbitration, a dispute is resolved by an arbitrator, or a panel of arbitrators, instead of a judge or jury.  As such, you hereby waive the right to go to court, including the right to a jury, act as a class representative or participate as a member of a class of claimants with respect to any Claim submitted to arbitration or litigation, regarding any Claim you have against any or all Sweepstakes Entities.  Prior to filing a Claim for arbitration with the AAA, each party agrees to attempt to resolve the Claim informally by notifying the other party in writing of the issue(s) underlying the Claim and both parties shall work in good faith to resolve such issue(s). To initiate an informal resolution to a Claim with Sponsor, you must send a notice by first class United States mail to Sponsor at the address above, Attention: General Counsel: Tax’n & Relax’n Sweepstakes Dispute Resolution Request. To informally resolve a Claim with another one of the Released Parties, you must send the notice through their registered agent.  If such resolution attempts are unsuccessful, a party may thereafter file a Claim with the AAA. No party may start a formal proceeding for at least 60 days after notice of an informal claim is made.  If you file and prevail on a Claim, Sponsor will reimburse you for your filing fees and costs in connection with the Claim.  You may elect to opt-out of arbitration by sending a letter (an “Arbitration Opt-Out Notice”) to Sponsor at the address above, Attention: General Counsel: Tax’n & Relax’n Sweepstakes Arbitration Opt-Out.  The Arbitration Opt-Out Notice must include (1) your first and last name; (2) your postal mailing address; (3) phone number; (4) email address; and (5) a clear statement that you do not wish to resolve disputes with Sponsor through arbitration.  The Arbitration Opt-Out Notice must be received no later than thirty (30) days from the date you were entered in the Sweepstakes. The Arbitration Opt-Out will apply only to Claims arising under this Sweepstakes and it not a general arbitration opt-out of all Claims with Sponsor or any Released Party.  In the event this Dispute Resolution provision is held unenforceable, in whole or part, you agree that all Claims shall be (i) governed by and interpreted under the laws of the State of New Jersey, U.S.A., without regard to its conflicts of laws provisions that may require the application of the laws of another jurisdiction, and (ii) brought and heard exclusively in the federal or state courts sitting in Jersey City, New Jersey, and you expressly consent to the jurisdiction of and venue in such courts and you waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. In such cases, you agree to service of process by mail or other method acceptable under the laws of the State of New Jersey.  ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

Privacy Policy: All Entries submitted become the property of the Sponsor and will not be acknowledged or returned. Sponsor collects personal information from you when you enter the Sweepstakes that will be used for the administration of the Sweepstakes and other purposes as described in Sponsor’s Privacy Policy found at http://www.jacksonhewitt.com/Privacy-Policy/ and the Sandals Prize Provider’s Privacy Policy available here https://www.sandals.com/general/privacy/.  Any information or the posts on Instagram, Facebook and X will be subject to the Meta and X privacy policy. 

Winners List: For the Names of the Grand Prize Winner — available after September 10, 2024 - send a self-addressed, stamped #10, business envelope to:  Jackson Hewitt Tax’n & Relax’n Sweepstakes Winners List, 10 Exchange Place, 27^th Floor, Jersey City, NJ 07302.  Requests must be received no later than October 1, 2024. You cannot enter the Sweepstakes using this address. Entries mailed to this address will be discarded.

Schedule A - (the “Sandals Prize”) – Additional Terms and Conditions

• Sandals Resorts are all-inclusive, Caribbean resorts for adults.
• Prizewinner and travel companion must be 18 years of age or older.
• The Sandals Prize will include accommodations consisting of one (1) room, double occupancy in a deluxe category room, all meals, unlimited Premium Liquors, daily & nightly entertainment, an array of land and water sports activities, including daily Scuba diving (for certified divers), snorkeling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes, and Sandals transfers to and from the selected or designated airport.

Exclusions: Airfare, car rental, personal charges, incidentals, telephone calls, Premium Wi-Fi, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, room services, meals outside of the selected or designated resort, island departure taxes, purchases made at the Sandals Specialty or Gift Shops, baggage fees, customs duties, and travel insurance are not included.

The Sandals Prize must be redeemed for travel within one (1) year from the date on the Prize Certificate (the “Redemption Period”) and is not transferable or redeemable for cash.  No extension will be given after the Redemption Period has expired. If the Sandals Prize is not redeemed, the Sandals prize will be forfeited.  The Sandals Prize is subject to space availability and selected blackout dates.  Reservations will not be confirmed until 30 days prior to the selected travel date.  Confirmation of travel dates will only be provided 30 days prior to the departure date.  Any federal, state and/or local taxes applicable to the Sandals Prize will be the prizewinner’s responsibility to pay.  The Prizewinner will receive from Jackson Hewitt Tax Services or its designee an IRS Form 1099 (or similar) in the amount of the Sandals Prize.  

Substitution of Resort: Unique Travel Corp: The Sandals Prize Provider and/or Sandals Resorts each reserves the right to substitute the selected resort for another resort in the resort’s chain in a similar category, and to change dates without prior notice for any circumstance(s) beyond the resort’s control based upon availability for the secured travel dates. The terms and conditions agreed to shall apply with equal applicability to any resort which is the subject of substitution or deviation.  Neither Unique Travel Corp nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

Compliance with Government Entities: Unique Travel Corp, its affiliates, and parent as well as Sandals Resorts and/or Sandals Resorts related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of the Agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.

Health and Safety: Sandals Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.

CLASS ACTION WAIVER: WITH RESPECT TO ANY MATTER OR DISPUTE INVOLVING THE SANDALS PRIZE, THE ACCEPTANANCE OF THE SANDALS PRIZE PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT AS A RESULT OF THIS AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST UNIQUE TRAVEL CORP – THE SANDALS RESORTS PRIZE PROVIDER WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. - TERMS AND CONDITIONS AVAILABLE HERE https://www.sandals.com/terms-conditions/ THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS. GUEST AGREES THAT THE PARTIES REFERENCED IN FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS THAT MAY BE THE SUBJECT OF ANY CLAIM BY GUEST CAN RECEIVE IMMEDIATE JUDICIAL ASSISTANCE TO ENFORCE THIS CLASS ACTION WAIVER.

 Travel Safety Warning:  All guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, for some destinations, may require guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre and post travel.   The prizewinner is advised to visit the travel.gov website before travel and to check the official Government website for the country visiting. The Sandals Prize Package provider and/or Sandals Resorts shall not be responsible for any additional costs incurred for any required test or any other pre-travel requirements.
